General Terms and Conditions of Sale

Article 1 – Seller's Identity

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between:

(hereinafter "the Seller")

and any natural person making a purchase via the website (hereinafter "the Customer").

Article 2 – Scope of application

These Terms and Conditions apply to all orders placed via the FastTrack website, hosted on the Shopify platform, and supersede any other terms.

The Customer declares having read these Terms and Conditions and having accepted them without reservation before validating their order.

Article 3 – Products

3.1 General Description

FastTrack designs and manufactures modular systems of helical ramps, track supports, pillars, clips and accessories for model railroading, primarily for Z (1/220) and N (1/160) scales.

The products are manufactured:

  • in small batches or on demand,

  • by laser cutting and/or 3D printing,

  • with a high level of precision.

3.2 Handcrafted nature and tolerances

Due to the artisanal and technical nature of the products:

  • Slight variations in color, texture or finish may exist.

  • minimal dimensional tolerances (on the order of a few tenths of a millimeter) are possible.

These variations do not constitute a defect as long as they do not affect the functionality of the product.

Article 4 – Compatibility and Use

4.1 Rail and rolling stock compatibility

The compatibility information provided with certain brands of rails or rolling stock is indicative only, based on the specifications of the manufacturers concerned.

The Seller cannot be held responsible for:

  • tolerance variations specific to third-party brands,

  • of the condition, wear or assembly of the rails,

  • specific characteristics of the rolling stock used.

It is the Client's responsibility to verify final compatibility with their network.

4.2 Slopes and performance

The slopes indicated are theoretical values ​​calculated on a geometric basis.

Actual performance depends in particular on:

  • the weight and length of the trains,

  • the number of wagons,

  • of the engine,

  • equipment maintenance.

No guarantee of universal performance can be given.

Article 5 – Modular and scalable products

FastTrack products are designed to be modular and scalable.

The Seller reserves the right to:

  • to develop its products,

  • improve their design,

  • modify certain technical details.

Compatibility with previous versions cannot be guaranteed indefinitely.

Article 6 – Personalized and custom-made products

Some products can be manufactured:

  • according to specific dimensions,

  • according to a specific configuration requested by the Client.

These products are considered personalized or custom-made.

In accordance with Article VI.53 of the Belgian Code of Economic Law , the right of withdrawal does not apply to these products.

All personalized orders are considered final after validation by the Client.

Article 7 – Price

Prices are shown in euros (€), inclusive of all taxes (TTC), excluding delivery charges unless otherwise stated.

The Seller reserves the right to change its prices at any time, without affecting orders already confirmed.

Article 8 – Order

The Customer's order confirmation constitutes:

  • acceptance of these Terms and Conditions,

  • acceptance of prices and product descriptions,

  • firm commitment to payment.

The Seller reserves the right to refuse or cancel any order in the event of a prior dispute with the Customer.

Article 9 – Payment

Payment is made via the secure methods offered on the Shopify platform.

The order is considered final upon receipt of full payment.

Article 10 – Retention of Title

In accordance with Articles 7.95 to 7.101 of the Belgian Civil Code , the delivered products remain the property of the Seller until full payment of the price, including principal and accessories.

Article 11 – Manufacturing and Delivery Times

Manufacturing and delivery times are provided for informational purposes only.

Given the artisanal nature and production on demand:

  • Reasonable delays may occur,

  • No compensation can be claimed in the event of a non-abusive delay.

The Seller cannot be held liable in the event of force majeure.

Article 12 – Transfer of Risks

In accordance with Article VI.44 of the Belgian Code of Economic Law , the risks of loss or damage to the products are transferred to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the products.

Article 13 – Right of withdrawal (non-personalized products)

In accordance with European legislation, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, only for non-personalised products.

Return shipping costs are the responsibility of the customer.

The products must be returned:

  • in perfect condition

  • complete,

  • unmounted

  • in their original packaging.

Article 14 – Legal guarantee of conformity

FastTrack products benefit from the legal guarantee of conformity , in accordance with articles VI.45 to VI.47/9 of the Belgian Code of Economic Law .

This warranty covers defects in conformity existing at the time of delivery of the product.

The legal guarantee does not cover, in particular:

  • normal wear and tear of the products,

  • defects resulting from incorrect assembly,

  • improper or misuse

  • modifications or adaptations made by the Client.

Article 15 – Assembly and responsibility

The assembly and installation of FastTrack products are carried out under the sole responsibility of the Customer.

The Seller cannot be held liable for:

  • due to incorrect assembly,

  • due to misuse,

  • indirect or consequential damages.

Article 16 – Support and advice

FastTrack offers support and technical advice for informational purposes.

These tips:

  • do not constitute a complete study of the network.

  • do not engage the Seller's responsibility for the final result.

Article 17 – Intellectual Property

All elements provided by FastTrack (products, plans, instructions, diagrams, texts, images) are protected by intellectual property law.

Any reproduction, distribution or use for commercial purposes is strictly prohibited without prior written authorization.

Article 18 – Liability

The Seller's liability is limited to the amount of the order in question.

The Seller shall not be liable for indirect damages, operating losses or intangible damages.

Article 19 – Personal Data

The Client's personal data is processed in accordance with the General Data Protection Regulation (GDPR).

They are used solely for order management and are never shared with third parties.

Article 20 – Applicable Law and Jurisdiction

These terms and conditions are governed by Belgian law.

In the event of a dispute, the courts of the judicial district where FastTrack's headquarters are located shall have sole jurisdiction.
